Australian Appeals Tribunal Rules on Release of Maintenance Data

SUMMARY: On 6 Aug. 2010, following an Australian Appeals Tribunal decision, the Civil Aviation Safety Authority released selected documents sought under the Freedom of Information Act to the Australian Licensed Aircraft Engineers Association.

MAJOR HIGHLIGHTS: In August 2007, the ALAEA made separate requests to CASA to obtain information under the Freedom of Information Act relating to commercial aircraft safety and maintenance standards.

On 6 July 2010, the Australian Appeals Tribunal issued an extensive ruling that disagreed with CASA’s original determination that the requested data was exempt from public release.

AEA COMMENTARY: This ruling is applicable to both the operators targeted by the FOIA request as well as maintenance organizations such as AEA members.  Every AEA member should review the decision and especially the “Schedule: Exempt Documents Claim” pages contained at the end of the decision.  This decision directly affects which maintenance information is and is not protected from public release.
